Supreme Court Issues Notice to Election Commission Over Plea Against CEC Gyanesh Kumar

New Delhi: The Supreme Court heard a significant petition concerning Chief Election Commissioner Gyanesh Kumar and the Election Commission. The petition had sought the suspension of the CEC, but the court declined to pass any interim order suspending him.

The Supreme Court issued a notice to the Election Commission and sought its response on the issues raised in the petition, including the ongoing Special Intensive Revision (SIR) of electoral rolls.

The court also examined questions concerning the manner in which decisions were taken by the Election Commission. The petitioners raised concerns over the approval and modification of Form-6, used in connection with voter registration.

Senior Advocate Ashwini Dubey told the court that, according to his submission, “We have not permitted any amendment or declaration in Form-6.”

The Supreme Court indicated that if any decision of the Election Commission was found to have been taken contrary to the applicable legal procedure, including the requirement of consensus or majority among the members, the court could examine its validity.

Will CEC Gyanesh Kumar Be Suspended?
